Choosing a Lawyer or Attorney for a Cerebral Palsy Case

Choosing a lawyer to represent you in a brain damage or neurological disorder case involves an evaluation of many things. Over the years I have chatted with many survivors and caregivers who tell me their lawyer specializes in Cerebral Palsy. Then they tell me their lawyer's name and I have never heard of this person. I have been actively involved in the national trial lawyer groups for more than 15 years and either know personally or have heard speak, most of the country's great lawyers. I am currently the Chair of the Traumatic Brain Injury Litigation Group of the American Association of Justice, the national trial lawyer's association (formerly American Trial Lawyers Association.)

In too many cases, the client had gotten the lawyer either from a TV ad or from was entrusting the file to the lawyer who did a will or real estate deal. Way too many times, the lawyer's staff knew little or nothing about Cerebral Palsy or brain damage. There are undoubtedly great lawyers out there who I do not know of. But a few questions from you should be able to give you a good idea of whether this attorney is involved in this or a related field.

This is my suggested list of questions:

  1. What seminars on brain damage or Cerebral Palsy has he or she attended?
  2. What national or state seminars has he or she spoken at?
  3. What trial lawyer groups that deal with brain damage, Cerebral Palsy or medical malpractice is he or she a member of?
  4. Do they have the kind of knowledge about brain damage, Cerebral Palsy or medical malpractice that you have found on these webpages?
